Acceptance of Terms

Your use of the Pure website (http://pure.co.uk/), owned and operated by Healthy Retail Limited, is subject to your acceptance of our Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms & Conditions. By using the website you are fully accepting the terms, conditions and disclaimers contained in this notice.

If you do not accept these terms and conditions you must immediately stop using the website.

Changes to our Website

We reserve the right to change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Pure shall not be liable to you for any such change or removal.

Interactive Services

Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

We will do our best to asses any possible risks for users (and in particular, for children.) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those at risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

The use of any of our interactive services by a minor is subject to the consent of their parent or guardian.   • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass alarm or annoy any other person.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspicion and Termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

Changes to our terms and conditions

We reserve the right to change these terms and conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

Links to Third Party Website

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

Copyright

All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Pure or otherwise used by Pure as permitted by law.

In accessing the Website you agree that you will access the content solely for your personal, non-commercial use.

None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

Virus, Hacking and Other Offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Liability

You agree that you use the Website entirely at your own risk and we accept no responsibility whatsoever, and hereby exclude to the fullest extent permissible by law, liability for any loss or damage which may be caused to you, your computer equipment or to any third party by using the Website, save to the extent that any person suffers death or personal injury as a result of our negligence. We are not responsible for any loss or damage caused by the temporary interruption of this site due to faults or circumstances outside our control.

Indemnity

You agree to indemnify and hold Pure and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Pure arising out of any breach by you of these terms and conditions or other liabilities arising out of your use of this Website.

Severance

If any of these terms and conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such term or condition shall be severed and the remaining terms and conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

Variation of Terms

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time and to take notice of any changes we make, as they hall be binding to you as from your first visit to the website following the change(s) being made. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Governing Law

These terms and conditions shall be governed by and constructed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

Cancellations

To cancel your delivery order please login to your account and visit the “Account History”. Select the order you want to cancel, and then press “Cancel this order”. Once this is complete, you will receive email confirmation. If you need help with this. please contact our team on deliveryteam@pure.co.uk

We do not accept same day cancellations or amendments to orders. Any order cancellations must be completed by 1pm the business day before the order is due for delivery. If you have paid by credit or with debit card, a fee may be applied for refunding your card in the event of cancellation. In some instances, a voucher to the same value as your order will be issued for future use on https://order.pure.co.uk, rather than a refund.

Click and Collect and Drop Point orders cannot be cancelled from your account. There is a small window where you can request it to deliveryteam@pure.co.uk as we will need to check if the food has already been prepared for you.

Refunds

Funds will be refunded at varying times, dependent on the card provider processing times. All funds will be refunded within 12 working days.

Magic Breakfast Charity Partnership  

We work with the charity Magic Breakfast (Charity No. 1102510) to help provide healthy, nutritious breakfasts to school children in disadvantaged areas of the UK. From February 2023, Pure will donate 56p – the cost of 2 healthy, nutritious breakfast for children and expert support for their schools for every catering order placed online at https://www.pure.co.uk/catering/
